(“FastLaneRecruit”, “FastLane”, “we”, “us”, “our”)
These Terms of Service (“Terms”) govern your access to and use of fastlanerecruit.com and any related pages, forms, portals, and services operated by AGENSI PEKERJAAN FASTLANE STAFF SOLUTION SDN. BHD. (the “Platform”), and our provision of recruitment, staffing, and Employer of Record (“EOR”) services (collectively, the “Services”).
By accessing the Platform, engaging our Services, submitting information, or signing up through any channel, you agree to these Terms. If you do not agree, do not use the Platform or Services.
1. Definitions
- “Company” means AGENSI PEKERJAAN FASTLANE STAFF SOLUTION SDN. BHD.
- “Client” means any business entity or person engaging the Company for Services.
- “Candidate” means any individual seeking employment, placement, staffing, or engagement via the Company.
- “EOR” / “Employer of Record” means a service where the Company (or its appointed partner, where applicable) may act as the legal employer for administrative, payroll, statutory, and HR compliance purposes, while a Client directs the individual’s day-to-day work.
- “Service Agreement” means any written agreement, proposal, statement of work, engagement letter, or signed document between the Company and a Client for Services.
- “Platform” means fastlanerecruit.com and any online forms or tools operated by the Company.
- “Personal Data” has the meaning given in our Privacy Policy and the Malaysia PDPA 2010.
2. Scope of Services
2.1 Recruitment & Staffing
We may provide Services that include sourcing, screening, shortlisting, interview coordination, and placement support.
2.2 Employer of Record (EOR)
For EOR arrangements, the Company may provide employment administration services such as:
- employment contracting (where applicable),
- payroll processing,
- statutory contributions and employment-related filings (where applicable),
- benefits administration (if included in the Service Agreement),
- HR administration relating to the employment relationship.
Important: Under EOR, the Client typically manages and is responsible for the individual’s day-to-day work direction, supervision, work scope, workplace policies, tools and systems access, and performance expectations, unless otherwise stated in the Service Agreement.
2.3 No Outcome Guarantee
We do not guarantee hiring outcomes, candidate performance, or employment continuation, as these depend on multiple factors including Client decisions and Candidate suitability.
2.4 Service Agreement Prevails
If you are a Client, the specific commercial terms (fees, timelines, replacements, rebates, termination, onboarding, SLA, etc.) will be set out in a Service Agreement. If there is a conflict between these Terms and the Service Agreement, the Service Agreement prevails.
3. Eligibility and Authority
You represent that:
- you have the legal capacity to enter into these Terms; and
- if acting for a company, you have authority to bind that company.
4. Candidate Terms
4.1 Accuracy
Candidates must provide accurate, complete, and truthful information (including CVs, employment history, qualifications). You must not submit misleading or false information.
4.2 Sharing with Clients
You acknowledge that we may share your profile and relevant information with Clients for recruitment, staffing, and placement purposes, subject to our Privacy Policy.
4.3 No Employment Promise
Submitting your information does not guarantee:
- interviews,
- offers,
- placement,
- employment through EOR, or
- employment duration.
4.4 Background Checks
Where applicable and permitted by law, Candidates may be required to undergo verification checks as part of recruitment or EOR onboarding (e.g., identity verification, reference checks), subject to consent and our Privacy Policy.
5. Client Terms (Recruitment/Staffing + EOR)
5.1 Client Responsibilities
Clients are responsible for:
- providing accurate role requirements,
- workplace supervision and direction,
- ensuring a safe work environment,
- compliance with applicable labour and employment laws relevant to the worksite and work arrangement,
- any required onboarding, access provisioning, and security policies.
5.2 Hiring Decisions
Clients make the final hiring/selection decisions. The Company is not responsible for Client selection outcomes.
5.3 EOR-Specific Responsibilities
Unless otherwise agreed in writing, Clients are responsible for:
- job scope and work instructions,
- approving time records, expenses, and leave requests (where applicable),
- workplace conduct and performance management input,
- ensuring role and working arrangement is lawful and compliant with applicable regulations,
- promptly notifying us of issues that may affect employment administration (e.g., worksite changes, misconduct, role changes).
6. Fees, Payment, and Taxes (Clients)
6.1 Fees, billing cycles, and payment terms will be set out in the Service Agreement and/or invoice.
6.2 Late payments may incur charges or interest as stated in the Service Agreement or invoice (subject to applicable laws).
6.3 Unless stated otherwise, amounts are exclusive of applicable taxes.
7. Acceptable Use of the Platform
You agree not to:
- interfere with the Platform’s operation,
- attempt unauthorised access,
- introduce malware,
- scrape or harvest data without permission,
- post unlawful, harmful, or infringing content.
We may suspend or restrict access to protect the Platform or other users.
8. Intellectual Property
All Platform content, branding, and materials are owned by or licensed to the Company. You may not copy, reproduce, or distribute our content without written permission, except as required for legitimate use of the Services.
9. Privacy and Personal Data Protection
Your use of the Platform and Services is subject to our Privacy Policy (Malaysia). By using our Services, you consent to the processing of Personal Data as described in that policy.
10. Third-Party Services
We may use third-party tools (e.g., communication, scheduling, document management, payroll systems) to deliver Services. We are not responsible for third-party systems beyond our reasonable control, but we will use reasonable care in selecting providers where appropriate.
11. Disclaimers
11.1 The Platform and general information on it are provided on an “as is” and “as available” basis.
11.2 We do not warrant uninterrupted access, error-free operation, or that the Platform will meet every requirement.
11.3 Recruitment and EOR outcomes depend on third parties, including Candidates, Clients, and regulators.
12. Limitation of Liability
To the maximum extent permitted by Malaysian law:
12.1 We are not liable for indirect, consequential, special, or punitive damages (including loss of profit, revenue, business, or goodwill).
12.2 Nothing in these Terms limits liability that cannot be excluded under applicable law.
13. Indemnity
You agree to indemnify and hold the Company harmless from claims, losses, damages, and expenses arising from:
- your breach of these Terms,
- unlawful use of the Platform,
- inaccurate or misleading information submitted by you,
- Client workplace conditions or work direction (for EOR arrangements), except to the extent caused by our proven negligence or wilful misconduct.
14. Termination
14.1 We may suspend or terminate Platform access if you breach these Terms.
14.2 For Clients, termination of Services will follow the Service Agreement (notice periods, offboarding, final invoices, etc.).
14.3 Sections intended to survive termination (including fees due, IP, disclaimers, liability limits, indemnity, and governing law) will survive.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Malaysia. You agree that the courts of Malaysia have jurisdiction over disputes arising out of or in connection with these Terms, unless a Service Agreement states otherwise.
16. Changes to These Terms
We may update these Terms by posting an updated version on the Platform. Continued use of the Platform or Services after changes means you accept the updated Terms.

18. Miscellaneous
- Severability: If any provision is invalid, the rest remain enforceable.
- No Waiver: Failure to enforce a right is not a waiver.
- Assignment: You may not assign these Terms without our written consent. We may assign to a successor or affiliate.
Entire Agreement: These Terms and any Service Agreement constitute the entire agreement for the Platform/Services.
